Please read these Terms of Service carefully before using the Fascia-Informed Continuing Education website, Podia storefront, courses, workshops, downloadable materials, certificates, discussion areas, messages, or other services.
These Terms of Service (“Terms”) are a legal agreement between you and Fascia-Informed Continuing Education (“Fascia-Informed Continuing Education,” “we,” “us,” or “our”). By visiting https://amymayer.podia.com/, creating an account, purchasing or enrolling in a course, registering for a workshop, downloading materials, participating in course discussions, messaging us, or otherwise using our services, you agree to these Terms.
These Terms work together with our Privacy Policy, available at https://amymayer.podia.com/privacy, and any other policies or course-specific terms we post, including any separate refund, cancellation, transfer, or workshop policy.
By using our site or services, you agree to follow these Terms and any additional terms that apply to a specific course, workshop, product, certificate, download, or event.
If you do not agree to these Terms, please do not use our site, courses, workshops, downloads, or services.
We may update these Terms from time to time. If we make changes, we will update the effective date or provide notice as appropriate. Your continued use of our services after changes are posted means you accept the updated Terms going forward.
Our services are intended for adults age 18 and older. By using our services, you represent that you are at least 18 years old and have the legal ability to agree to these Terms.
If you register on behalf of a business, organization, or another person, you represent that you have authority to do so and to provide any information needed for the registration or purchase.
We may refuse, suspend, or discontinue access to our services if we believe a user has violated these Terms, provided inaccurate information, misused our services, or used our services in a way that may create legal, safety, security, or business concerns.
Some services may require you to create or use a Podia account. You agree to provide accurate and complete information and to keep your account information current.
You are responsible for maintaining the confidentiality of your login information and for all activity under your account. Please do not share your login information, allow others to use your account, or post account access information publicly.

Your personal information is handled according to our Privacy Policy at https://amymayer.podia.com/privacy.
Because our storefront and courses are hosted on Podia and payments may be processed through Stripe or another payment processor supported by Podia, those service providers may also process information according to their own terms and privacy policies.
Fascia-Informed Continuing Education provides educational content, continuing education courses, in-person workshop registration, downloadable materials, and related learning resources.
Certificates may be issued through Podia after course completion when a course or workshop includes a certificate. A certificate confirms completion of the applicable course or workshop requirements; it does not guarantee license renewal, professional credential approval, employer approval, reimbursement, or continuing education credit unless that is expressly stated for the specific course or workshop.
You are responsible for determining whether a course, workshop, certificate, or learning activity meets your professional, licensing, employer, state, board, or continuing education requirements.
Our services and content are provided for educational purposes only. They are intended to support professional learning, critical thinking, and innovation.
We may describe concepts, techniques, approaches, or examples that may be useful in practice. You are solely responsible for applying your own clinical reasoning, professional judgment, scope of practice, training, licensure requirements, and applicable professional standards when deciding if, when, and how to use any information.
Our services and content are not medical advice, do not diagnose, treat, cure, or prevent any disease or condition, and do not replace professional medical advice. Use of our services does not create a clinician-patient relationship between us and any student, client, patient, or third party.
Some courses, workshops, downloads, or other services may require payment. Prices, payment options, taxes, and checkout terms will be shown at or before purchase.
Payments are processed through third-party payment processors, such as Stripe, through the Podia platform. Payment processing is also subject to the terms and privacy policies of the payment processor and Podia. We are not responsible for payment-processing errors, bank fees, card issuer fees, declined payments, or delays caused by third-party payment systems.
By making a purchase, you authorize the applicable payment processor to charge your selected payment method for the amount shown at checkout, including any applicable taxes or fees.
If we offer a payment plan, subscription, installment, or recurring payment option, the applicable payment schedule and terms will be disclosed at checkout. By choosing that option, you authorize the scheduled charges unless and until the plan is completed or canceled according to the applicable terms.
Refunds, cancellations, transfers, no-shows, workshop changes, and related payment issues are governed by our separate posted refund and cancellation policy, if applicable, and by any course- or workshop-specific terms shown at purchase or registration.
We aim to provide a smooth and engaging learning experience, but we do not guarantee that our site, Podia, course content, downloads, certificates, messages, discussions, or other services will always be available, uninterrupted, error-free, or compatible with every device or internet connection.
Access may be interrupted or limited because of maintenance, updates, technical issues, internet problems, platform outages, payment issues, account issues, or circumstances outside our control.
We may update, revise, remove, suspend, or discontinue content, courses, workshops, downloads, or features when reasonably necessary, including for accuracy, quality, legal, safety, platform, or business reasons.
Unless otherwise stated, all course materials, videos, audio, slides, handouts, downloads, worksheets, written content, graphics, logos, course names, frameworks, and other materials provided by Fascia-Informed Continuing Education are owned by us or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
When you purchase, enroll in, or access a course or workshop, we grant you a limited, personal, non-exclusive, non-transferable license to view, download, and use the materials for your own individual learning and professional reference.
You may not copy, share, resell, publish, post, distribute, teach from, modify, upload, reproduce, or create derivative works from our materials except with our prior written permission or as expressly allowed in writing.
You must keep all copyright notices, ownership notices, and use restrictions included in or on any course or workshop materials.
Some courses or services may allow you to post comments, participate in discussions, submit responses, message us, or otherwise share content (“User Content”).
You are responsible for the User Content you submit. You agree that your User Content will be accurate to the best of your knowledge, lawful, respectful, and appropriate for the learning environment.
Course discussions may be visible to us and to other enrolled students who have access to that course area. Private messages may be visible to us and to service providers that operate the platform.
Please do not post or send sensitive personal information, health information, medical information, confidential client or patient information, financial account information, identification documents, or information about another person unless you have permission and it is appropriate to share.
We may remove or moderate User Content if we believe it violates these Terms, infringes rights, creates safety or privacy concerns, disrupts the learning environment, or is otherwise inappropriate.
From time to time, we may ask students for testimonials, reviews, comments, suggestions, or feedback.
We will use testimonials publicly only with your permission and in the way you approve. If you send general feedback or suggestions about our services, you allow us to use that feedback to improve our courses, workshops, materials, and business without owing compensation to you.
You agree not to use our services in a way that:
Violates any law, regulation, professional requirement, or these Terms
Infringes anyone’s copyright, trademark, privacy, publicity, confidentiality, or other rights
Shares another person’s private, sensitive, health, medical, financial, or confidential information without permission
Is false, misleading, harassing, abusive, defamatory, discriminatory, obscene, threatening, or disruptive
Interferes with another student’s learning experience
Attempts to gain unauthorized access to accounts, systems, content, certificates, or paid materials
Shares login credentials or allows unauthorized users to access paid content
Copies, scrapes, downloads, records, redistributes, resells, or commercially exploits our content or services without permission
Uploads viruses, malware, harmful code, spam, or unauthorized advertising
Impersonates another person or misrepresents your identity, credentials, affiliation, completion status, or authorization
We may suspend or terminate access if we believe these rules have been violated.
Our services may be provided through or link to third-party platforms, services, websites, resources, or tools, including Podia and payment processors such as Stripe.
We do not control third-party services and are not responsible for their content, availability, security, privacy practices, terms, errors, or actions. Your use of third-party services may be subject to their own terms and policies.
We work to provide high-quality, engaging educational content. However, we do not guarantee any specific professional, clinical, business, financial, licensing, certification, continuing education, employment, or other outcome from using our services.
Your results depend on many factors outside our control, including your background, training, professional judgment, practice setting, licensing requirements, employer policies, and how you choose to use the information.
To the fullest extent permitted by law, our site, services, courses, workshops, content, certificates, downloads, discussions, and materials are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Some jurisdictions do not allow certain warranty limitations, so some of these limitations may not apply to you.
To the fullest extent permitted by law, Fascia-Informed Continuing Education and our owners, employees, contractors, representatives, service providers, and content providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including lost profits, lost revenue, loss of data, loss of goodwill, business interruption, professional consequences, or substitute services.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services, content, or these Terms will not exceed the greater of: (a) the amount you paid us for the specific course, workshop, product, or service giving rise to the claim during the three months before the event giving rise to the claim; or (b) $500.
Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to defend, indemnify, and hold harmless Fascia-Informed Continuing Education and our owners, employees, contractors, representatives, service providers, and content providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:
Your use or misuse of our services, content, or materials
Your User Content
Your violation of these Terms
Your violation of any law, regulation, professional requirement, or third-party right
Your sharing of another person’s private, confidential, health, medical, financial, or sensitive information without permission
Your use of our educational content in a way that is inconsistent with your own professional judgment, scope of practice, clinical reasoning, laws, regulations, or professional standards
We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate with us in that defense.
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles.
Any legal action or proceeding arising out of or relating to these Terms, our services, or your use of our services must be brought in the state or federal courts located in Nebraska, unless applicable law requires otherwise. You consent to the personal jurisdiction and venue of those courts.
To the fullest extent permitted by law, any dispute must be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, representative, or private attorney general proceeding.
We may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property, confidential information, platform access, security, or other rights.
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including internet or platform outages, payment processor issues, technical failures, natural disasters, illness, travel disruptions, emergencies, acts of government, labor disputes, or other events outside our control.
We may suspend, restrict, or terminate access to our services if we reasonably believe you have violated these Terms, failed to pay amounts due, misused content, created safety or privacy concerns, disrupted the learning environment, infringed rights, or engaged in unlawful or inappropriate conduct.
Termination or suspension does not limit any rights or remedies available to us, including payment obligations, intellectual property rights, or legal claims.
These Terms, together with our Privacy Policy and any applicable course-, workshop-, refund-, cancellation-, or purchase-specific terms, make up the agreement between you and Fascia-Informed Continuing Education regarding the services.
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision does not waive our right to enforce it later.
You may not assign or transfer your rights under these Terms without our written permission. We may assign or transfer our rights and obligations as part of operating, reorganizing, or transferring our business.
The headings in these Terms are for convenience only and do not affect interpretation.
